PRIVACY POLICY

1.  Introduction

Quantum Mobility, LLC (“QMI”) recognizes the importance of protecting your personal information. We take the protection of your personal information seriously and we want each applicant and Member to feel comfortable whensubmitting applications for membership. This Privacy Policy provides information on how we collect, store, use anddisclose any personal information provided to us in connection with the QMI membership application process and during your tenure as a member of QMI (“you” or “Member”). The protection of your privacy when processing your personal information is an important matter for us, which we account for in our business processes. This Privacy Policy does not apply to data from which personal identifying information has been removed. We retain the right to use such data in any way we deem necessary to advance our business interests. This Privacy Policy does not apply to other internet sites even if accessed via our website.  By continuing to use the QMI website, mobile applications, or other Services, you agree to and acknowledge the terms of this Privacy Policy.

For Canadian-resident Members only: The Personal Information Protection and Electronic Documents Act (PIPEDA) is a federal law in Canada that applies to QMI’s eventual Canadian operations. PIPEDA regulates the collection, use andhandling of personal information. If you are located in Alberta, British Columbia or Quebec, provincial privacy lawsmay also apply to our handling of your personal information.

2.  Consent

When you provide us with your personal information, you consent and agree to our use and disclosure of your personal information in accordance with this Privacy Policy.

The personal information that we collect about you will be with your consent, by your application for membership. To the extent permitted by law, your consent may be implied or express. We may collect personal information directly from you by phone, fax, or e-mail, through your use of our website or other applications, or through your use of ourvehicles.

You may choose not to provide some or all of your personal information to us, but this may prevent us from providing our Services to you or limit our ability to provide you with the level of service that you would otherwise expect from us as a Member.

We may use your email address to provide you with account-related communications or marketing or other information. You may direct that we refrain from using your email information to send marketing information.

3.  Personal Information Generally Defined

As used in this Privacy Policy, “personal information” means any information pertaining to an identifiable individual. This may include an individual’s name in combination with the individual’s address, date of birth, e-mail address,gender, driver’s license number, government issued identification number, driver’s abstract, account number, and creditor debit card number. This may also include any information from which a living individual can be identified directly,or indirectly, in particular by reference to an identification number or to one or more factors specific to their physical,physiological, mental, economic, cultural or social identity.

To the extent permitted by law, personal information does not include the name, title, businesses address or office telephone number of an employee of an organization, or the name, address, telephone number or other information of a person that is publicly available (e.g., such as the information that is available in a public telephone directory).

4.  Use of Personal Information

As part of the membership application process, QMI may collect personal information, as defined in this Privacy Policy, for the purpose of evaluating applications for QMI membership and administering the QMI membershipprogram. QMI also may collect personal information, as defined in this Privacy Policy, in connection with a Member’srequest to purchase mobility services from QMI and a Member’s use of QMI services (such as QMI’s car-sharing program; collectively, the “Services”) and from other mobility service providers, and in connection with transactions and other matters relating to such Services. Any information collected may also be stored, retained or used in otherQMI business processes including, but not limited to, membership renewal, periodic membership validation, member account-management and payment authorization as well as administration of and compliance with the terms and conditions under which QMI and other mobility service providers provide their mobility services. Some of the personal information provided must necessarily be shared with third parties including, but not limited to, insurance companies, other mobility service providers you elect to use through QMI, including those located outside of the United States, entities responsible for vehicle maintenance and vehicle safety call-centers. By initiating the application process or applying to use QMI mobility services, you consent to the sharing of your personal information that QMI deems necessary. Any information shared with a third party will not be beyond what is necessary and each third party willmaintain its own Privacy Policy and enter into an appropriate data protection agreement with QMI. Any personal information collected but not stored or maintained in the regular course of business will be securely destroyed.

In order to better serve you and your driving habits, QMI may employ electronic trip data collection, including electronic and real-time connections to the vehicles internal systems, as well as external electronic hardware andsoftware and/or QMI vehicles may be equipped with video recording or other data collection mechanisms. These functions may provide functions such as vehicle location, speed, travel times and other personal information used tocalculate and/or verify invoices, maintenance and safety. This data may also be used to prevent fraudulent usage of QMI vehicles and/or issue fines for late returns and other use outside the boundaries of the vehicle reservation.  You should have no expectation of privacy when you are inside or operating a QM vehicle.

5.  Collection of Personal Information

Through the QMI website and/or QMI mobile application, visitors can gather information about carsharing and QMImembership. Personal information directly requested by and submitted in connection with the membership applicationprocess is collected and stored only if you voluntarily submit it to QMI.   Other information about you is automatically collected including, but not limited to, your IP address, hosting server, browser, operating system,browser language and service provider.

The servers used by QMI are located within the United States. Notwithstanding the location of the servers in the United States, QMI has processes in place to protect your personal information in accordance with applicable privacy laws.

QMI may also record telephone conversations with Members in connection with memberships, in order to clear up legalissues and/or to improve the quality of its vehicles and Services.

As part of the normal course of your membership and use of the Services, QMI may also have access to, and collect, personal information about you from: traffic tickets, electronic highway toll systems, parking lot tickets and other data systems. Where this information pertains to monitoring the safe, lawful and agreed-upon use of our vehicles including, but not limited to whether you were in control of a vehicle at a specific time as can be ascertained by such personal  information, you give QMI your express consent to obtain and use this personal information.

6.  Sharing of Personal Information with Affiliates and Third Parties

QMI may share personal information with its parent, affiliates and with third parties acting on QMI’s behalf or at itsdirection for purposes relating to QMI operation, maintenance, administration, improvement and Member oversight.The global nature of the QMI business sometimes requires QMI to transfer personal information across nationalborders. Accordingly, personal information will be subject to the legal requirements of the applicable foreignjurisdictions, including local requirements to disclose information to courts, law enforcement and national securityauthorities.

Disclosure of personal information may occur in connection with a corporate transaction, proceeding or reorganization of QMI or the business processes for which the information is maintained. More specifically, in the event that QMI intends to sell or transfer ownership or control of any or all of our business, operations or services to a third party, wereserve the right to disclose certain personal information to a potential buyer both before and after the purchase, subject to conditions discussed below. We will require that the receiving party agree that they will be similarly bound by the provisions of this Privacy Policy and that they will only use and disclose your personal information as QMI is similarly entitled under this Privacy Policy. In the event the sale does not go through, QMI will require the potential purchaser to not use or disclose your personal information in any manner whatsoever and to completely erase the same. Personal information may also be disclosed as permitted or required by law or when QMI believes disclosure is necessary to protect its rights and/or comply with a judicial proceeding, court order or other applicable law.

QMI does not disclose or sell your personal information to third parties for marketing purposes.

Without limiting the foregoing, we may disclose your personal information to:

  • your company or organization if you use our Services under a corporate account;
  • your credit card issuers;
  • credit reporting and fraud checking agencies;
  • debt collection agencies, if you fail to pay monies owed to us;
  • government or private organizations responsible for the processing or handling of traffic or parkingrelated violations;
  • driver licensing authorities, directly or through intermediary organizations, when needed to verify compliance with QMI’s safe driver criteria and/or to verify license personal information;
  • government, regulatory and law enforcement agencies where the disclosure is required, authorized or permitted by law;
  • insurance companies; and
  • third party mobility service providers you access through

7.  Security and Notice of Breach

QMI complies with industry standards to protect the personal information it maintains from misuse, loss, unauthorized access and modification or disclosure in violation of this Privacy Policy. This protection applies in relation to personal information stored in both electronic and hard copy form. QMI will notify its Members as promptly as possible of any privacy breach after discovering or receiving notification of the breach if QMI reasonably believes the information has been acquired by an unauthorized person or is subject to an unauthorized use. Access to the QMI databases is restricted to authorized personnel and is password protected. Information transmitted through our website is encrypted.

QMI will exercise commercially reasonable efforts to safeguard the confidentiality of personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, QMI shall not be liable for unauthorized disclosure of personal information due to no fault of QMI including, but not limited to, errors in transmission and unauthorized acts of QMI staff and third parties.

8.  Access to Personal Information

Upon request, you may access certain personal information collected by QMI, that QMI maintains at the time of your request. To the extent technologically feasible, QMI will provide reasonable and practical access to your  personal information. We will normally provide access without charge, although we may impose  a reasonable fee in some limited situations. We will, however, advise you of that fee in advance. Details of how to contact us are set out below.There may be instances where QMI cannot provide you access to your personal information, for certain reasons, including, but not limited to, it has been destroyed or deleted after expiry of applicable retention periods, it contains personal information of other persons or it contains commercially sensitive or proprietary information owned by us. If we are unable to provide you access, we will explain why and document that for our records.

9.  Accuracy/Correction of Personal Information

When reasonable and commercially practicable, QMI upon notice, will correct any inaccuracies in your personal information.   Personal information may also be accessed and edited personally at www.qmcarsharing.com.

10.  Use of Website Tracking

An IP address is a unique number that is automatically assigned to your computer whenever you are surfing the Internet so that your computer can be identified by the main computers, known as Web servers that serve Web pages.   This allows us to identify and gather general information about your use of the site, such as the Web pages viewed on QMI to provide you service.

QMI collects IP addresses for the purposes of: helping us diagnose problems with our main computers, for system administration, to report aggregated personal information to our business partners and to audit the use of our website.   When users request web pages from our website, our web servers log the user’s IP address. We do not normally link IP addresses to anything personally identifiable, which means that a user’s session will be logged, but the user will remainanonymous to us. For example, we collect and/or track the home server domain name, the type of computer, and the type of web browser used by you to access our website. Such collection and tracking personal information is gathered by us as you navigate through our website, and will be used by us for our business purposes only. We can, and will, use IP addresses to identify you when we feel it is necessary to enforce compliance with our website Terms and Conditions or to protect our service, site, users, or others.

11.  Use of Computer Tracking Technologies

  • No Tracking of Personal Information. QMI’s website is not set up to track, collect or distribute personal information not entered by visitors. Through website access logs, QMI does collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making, all of which provides better services to the public. The statistics garnered, which contain no personal information and cannot be used to gather such information, may also be provided to third parties.
  • Use of Cookies. QMI, or its third-party vendors, collects non-identifiable and personal information through the use of various technologies, including “cookies.” A cookie is an alphanumeric identifier that a website can transfer to customer’s hard drive through customer’s browser. The cookie is then stored on customer’s computer as an anonymous tag that identifies the customer’s computer, but not the customer. Cookies may be sent by QMI or its third party vendors. Customer can set its browser to notify customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customer may also set its browser to turn off cookies; however, some websites may not then work properly, and this may also limit your ability to use the QMI website.
  • Use of Web Beacon Technologies. QMI may also use Web beacon or other technologies to better tailor its website to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Web site, a non-identifiable notice of that visit is generated which may be processed by QMI or by its suppliers. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer’s visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.
  • Collection of Non-Identifiable Information. QMI may collect non-identifiable information from user visits to the QMI Website in order to provide better customer service. Examples of such collecting include traffic analysis, such as tracking of the domains from which users visit or tracking numbers of visitors; measuring visitor activity on the QMI website; website and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” QMI or its contractors may use this data to analyze trends and statistics.
  • Collection of Personal Information. QMI collects personal identifying information (personal information) from customer during a transaction. QMI may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help QMI understand trends and patterns. This information is not reviewed at an individual level.

12.  Changes to Privacy Policy

QMI reserves the right to change this Privacy Policy from time to time. Any changes to this Privacy Policy will be posted at www.qmcarsharing.com/privacy-policy. All changes are effective on the earlier of (1) the effective dateindicated in the notice; or (2) on the date posted on the QMI website. QMI will provide you with disclosures and alerts regarding this Privacy Policy by posting them on our Website, by emailing the email address listed in your membership account, and/or by mailing to the physical address listed in your membership account. You agree that electronic disclosures and notices have the same meaning and effect as if we had provided you with a paper copy. Such disclosures and notices in relation to this Privacy Policy shall be considered to be received by you within 24 hours of the time it is posted to our website or emailed to you (unless we receive notice that the email was not delivered).

14.  Terms of Use

          If a customer chooses to subscribe to QMI’s Services, customer’s action is hereby deemed acceptance of QMI practices described in this Privacy Policy. Any dispute over privacy between customer and QMI is subject to the provisions of this Privacy Policy and to QMI’s Terms and Conditions Agreement which is hereby incorporated herein and which can be read at https://qmcarsharing.com/terms-and-conditions.  In the event of any conflict between this Privacy Policy and the Terms and Conditions Agreement, the Terms and Conditions Agreement shall prevail.

This Privacy Policy is effective December 1, 2025.
